Terms and Conditions

Article 1 (Formation of contract)
Once the applicant to DIG International Co., Ltd. (hereinafter referred to as the “First
Party”) has agreed to the following terms and conditions and has made an application for
admission to DIG International (hereinafter referred to as the “Second Party”) today,
and upon the Second Party’s acceptance, a contract based on the Act on Specified
Commercial Transactions (hereinafter referred to as “Act”) will be formed.

Article 2 (Provision of services and payment for services)
1. The Second Party shall provide the First Party with the services described in the
contract, which are selected by the First Party from the study guidance curriculum
specified by the Second Party.
2.The First Party shall pay the tuition fee, facility fee, and other fees by the due date
in accordance with the amount and method described in the contract.

Article 3 (Forms of instruction)
The forms of instruction described in the contract shall be as follows.
1. A group lesson is one in which one tutor teaches multiple students (3 or more)
in an in-person/online class format on a scheduled day/time.
2. A semi-private lesson is one in which one teacher provides instruction to two
students in an in-person/online class format on a scheduled day/time.
3. A private lesson is one in which one instructor provides one-on-one instruction
in an in-person/online class format on a scheduled day/time.

Article 4 (Start date of instruction)
In this Agreement, the start date of instruction is the date on which the instruction
begins in the designated classroom, and not necessarily on the date of application.

Article 5 (Location of instruction)
The Second Party shall provide the instruction at the location described in the contract.

Article 6 (Instruction period and contract term)
The period of instruction shall be within the contract period stated in the contract. The
standard contract period is one year (12 months).
No renewal fee shall be charged at the time of renewal.
In the event of any change in the content or terms of the contract, a new contract shall
be prepared to confirm the agreement between the two parties, and this contract shall be
terminated at that time.

Article 7 (Related products)
The course materials (teaching materials, books, etc.) required for the course can be
purchased at bookstores or on the Internet.

Article 8 (Cancellation of contract/cooling off)
1. The First Party may cancel the contract in writing for a period of 8 days from the date
of agreement to this contract.
2. The cancellation of the contract shall take effect when the Second Party issues the
document for the cancellation of this contract.
3. When the contract is cancelled, the Second Party shall not be able to claim any
compensation for damages or seek a penalty against the First Party for the cancellation of
the contract.
4. When the contract is cancelled, even if lessons have already been provided, the Second
Party may not claim for any damages or seek a penalty payment against the First Party
associated with the cancellation of the contract.
5. When the contract is cancelled, if the payment has already been completed, the full
amount shall be returned to the First Party promptly.
6. When the contract is cancelled, the First Party shall return the textbooks, books, and
other materials.
7. When the contract is cancelled, the cost of returning and handling of the textbooks,
books, and other materials, shall be borne by the Second Party.
8. If the First Party is misled or intimidated into not proceeding with cooling off, the
First Party may proceed with cooling-off for an additional 8 days, including the day when
the First Party receives another written agreement that they may proceed with cooling off.
*If the term of the contract is 2 months or less, or if the total amount paid by the First
Party to the Second Party is 50,000 yen or less, the cooling off provisions does not
apply.

Article 9 (Cancellation and termination of contract)
1. After 8 days from the date of agreement to the contract, the First Party may cancel the
contract by submitting a written notice to the Second Party.
2. In the event of cancellation, the Second Party shall promptly return to the First
Party, the amount obtained by deducting the fees, damages, and penalties. However, if the
amount already paid is less than the fees, damages, and penalties, the First Party shall
pay the difference to the Second Party.
① Cancellation of the contract before the start of the course
The Second Party shall return to the First Party the amount of money already paid, minus
15,000 yen as the initial fee (the amount specified by a government ordinance as the cost
normally required to conclude and execute a contract). Since the initial fee is not
charged at the time of cancellation of the contract, a part of the amount already paid
shall be deemed as the initial fee and shall be deducted from the amount already paid.
However, if the amount already paid is less than the initial fee of 15,000 yen, the
difference shall be paid.
② Cancellation of the contract after the start of the course
The Second Party shall refund to the First Party the amount already paid minus the fees,
damages, and penalties.
• Tuition fee for the lessons that have already been provided (unit price per lesson x
number of lessons that have already been provided).
• The initial fee (the amount specified by a government ordinance as the cost normally
required to conclude and execute a contract) will be 15,000 yen, and since the initial fee
is not charged at the time the contract is concluded, a portion of the amount already paid
will be deemed as the initial fee and deducted.
• An amount equivalent to 20% of the remaining tuition as a damage/penalty fee for the
cancellation of the contract. However, the amount will be no greater than 50,000 yen.
* Group classes may not be cancelled by the First Party, but the Second Party reserves the right to cancel
group classes under special circumstances.

Article 10 (Method of refund in advanced/mid-term cancellation)
In the event of cooling off in accordance with Article 8 or premature cancellation in
accordance with Article 9, the Second Party shall promptly return the payment received
from the First Party by way of transfer to the bank account designated by the First Party.
The transfer fee for the transfer to the bank account shall be borne by the First Party.

Article 11 (Suspension/cancellation notice)
If the First Party wishes to suspend or withdraw from their membership, the First Party
shall notify the Second Party by the 10th of the previous month, fill out the prescribed
form, and submit it to the Second Party. If no request is made within this deadline, the
tuition will be withdrawn and cannot be returned.

Article 12 (Preservation of advanced payment)
The Second Party does not take any measures to protect the payment of tuition, facility
usage fees, etc.

Article 13 (Connection of the right of defense)
When the First Party is paying in installments with respect to the contract, the First
Party may suspend payment for any reason arising between it and the Second Party until the
matter is resolved.

Article 14 (Settlement of disputes)
1. In the event that any question arises regarding the matters set forth in this Agreement
or the contents of the Agreement, or in the event that any dispute arises regarding this
Agreement, such disputes shall be resolved through discussion between the parties.
2.Any matters not stipulated in this Agreement, or the Terms and Conditions shall be
governed by the Civil Code, the Act on Specified Commercial Transactions, and other
related laws.

Article 15 (Special agreement)
If there is no change in the contents of the contract of the First Party after the
contract period has expired, the contract shall be automatically renewed

Membership Agreement

Article 1 Membership Agreement
The DIG International Membership Agreement sets forth the terms and conditions for the use
of DIG International.

Article 2 Changes to the Agreement
1. This agreement can be revised, changed, or new provisions can be added at the
school’s convenience without the consent of DIG International members. In this
case, the terms and conditions of member services shall be in accordance with the
revised terms.
2. The revised terms and conditions shall apply to all members, regardless of whether
the agreement was made before or after the revision. Please be aware of this in
advance.

Article 3 DIG International Membership
DIG International members are those who have agreed to the terms of this agreement, have
applied for membership in DIG International, and have been accepted by the school.

Article 4 Notification of Changes
1. If there is any change in the name, address, telephone number, or any other
information provided to the school in the membership list, the student shall notify
the school of the change as soon as possible.
2. In the event of any resulting disadvantage, such as from a failure to receive
notices from the school due to a failure to notify the school of an address change,
the school shall not be liable for any resulting losses.

Article 5 Management of Personal Information
1. The school will handle members’ personal information in an appropriate manner.
2. The school will manage registered information as personal information but may
provide or disclose specific personal information to a third party in the following
cases.
1. When the consent of the member has been obtained.
2. When disclosure is requested by a public institution in accordance with laws
and regulations.

Article 6 Lesson Types and Fees
1. There shall be three types of lessons/classes as follows (a) Private, (b) Semi-
Private, and (c) Group.
2. Lessons may be conducted in (a) in-person (b) online (c) hybrid (online and inperson)
format.
3. Please refer to the course list for each course and its fees.
4. Semi-Private Lessons and Private Lessons must be taken at least twice a month.
5. Admission fee: 16,500 yen
6. Group lessons are based on a monthly fee system which is not prorated, even if you
join or withdraw in the middle of the month.
7. Facilities and system usage fee (including online system, heating, etc.): 1,000
yen/month
8. Please understand that lesson time may vary depending on the type of lesson.

Article 7 Payment
Please make payments to the school by automatic withdrawal via Japan Post Bank or via
credit card payment.
In the case of automatic withdrawal
The fee will be deducted on the 27th of the previous month. Subsequent withdrawals shall be
made on the 10th of the following month. (If the payment date is a Saturday, Sunday, or a
national holiday, the payment will be made on the following business day.
You will need to complete the procedures at a financial institution. Please note that only
Japan Post Bank is accepted for this procedure. You will need to pay the
transaction/handling fee.
*If the automatic withdrawal is unable to be completed on the 27th of the previous month (due to
unavailability of funds or for other reasons), a subsequent automatic withdrawal is scheduled for the 10th of
the following month. However, this will carry a late fee charge of 1000 yen.
In the case of bank transfer
If there are any additional charges, please transfer the money to us. The due date for the
transfer will be specified.
If we are unable to confirm payment after the due date for either automatic bank
withdrawal or bank transfer, we will charge a separate administrative fee of 1,000 yen.

Credit Card Payment
All payments via credit card should be made by 27th of the previous month.

Article 8 Absence, substitution, and class cancellation
1. Classes will be cancelled during major holidays (GW, Obon, Silver Week, New Year’s)
and other holidays designated by the school. In the event that a group lesson is
cancelled due to a major holiday, there will be no refunds or exchanges of lessons.
2. We will contact you by e-mail when we cancel classes. Please make sure that our
email ([email protected]) reaches your inbox.(Please make sure it does not enter
your spam folder)
3. No refunds will be made after payment has been made.
Group Lesson Students
1. If you miss a lesson for personal reasons, we will not be able to provide a
replacement lesson or refund. If you wish, you may request a private lesson for a
fee. Please contact your instructor for details. The fees for private lessons will
apply.
2. Group lessons are not transferable. Please be aware of this in advance.
3. In the event of a disaster such as a major earthquake or other emergency, classes
will be temporarily cancelled. In such cases, no refunds will be made.
4. In the event that an instructor is unable to conduct a lesson due to unavoidable
circumstances, no refunds or replacement lessons will be made.
Semi-Private and Private Lesson Students
1. If you wish to change the date or time of a semi-private or private lesson, please
contact the school at least one day before the lesson date. If you change your
lesson date after this deadline, you will be considered to have taken the lesson
and no replacement lesson will be given.
2. You can only change the date and time of your lesson once a month, and you cannot
change the date across months. Please note that we will not be able to accommodate
your request if we are unable to arrange the schedule with the instructor.
3. In the event that a teacher is unable to teach a lesson due to unavoidable
circumstances, a replacement lesson will be provided. The date and time of the
replacement lesson must be arranged with the instructor.
4. If you choose to schedule semi-private or private lessons on a fixed day and time
each month, you will receive the same number of lessons (4 to 5 lessons) as in the
calendar weeks.
5. A minimum of two lessons per month is required.

Article 9 Online/In-person Rules
1. Appointments may be cancelled up to 24 hours prior to the session start time.
1. No refunds will be made. However, for Private and Semi-Private classes,
only one substitute class may be scheduled before the end of the month due
to the availability of the instructor.
2. If a student cancels an appointment within 24 hours, the student will be
considered absent, and the class will be cancelled. No refund or substitute
class will be provided.
2. If an online class session fails due to improper computer or internet settings on
the part of the customer (e.g., computer, microphone, speakers, internet
connection, etc.), DIG International will not issue a refund or provide an
alternative class.
3. If a student does not show up within 15 minutes of the scheduled class start time,
the class will be considered cancelled. In such cases, no refunds or replacement
classes will be provided.
4. If a student is absent for five consecutive classes without prior notice, the
student will be placed on temporary hold, and if there is no further contact, the
registration may be cancelled. In such cases, there will be no refund of course
fees or replacement classes.
5. The selection of the instructor at the beginning of the contract shall be made by
the school. The school reserves the right to change teachers in the middle of the
contract period based on the requirement of the course, student, or the school.

Article 10 Suspension and Withdrawal
1. If a student wishes to suspend or withdraw from the course, please fill out the
designated form and submit it to the school by the 10th of the previous month. In
this case, no monthly fee will be charged.
2. If a student wishes to cancel or withdraw from a course in the middle of the month,
the lesson fee will not be refunded on a prorated basis.
3. In the event that a student withdraws from a class in the middle of the month, the
lesson fee and facility usage fee (including heating fee) will not be refunded.

Article 11 Purchase of Teaching Materials
The school does not sell teaching materials. Please purchase the designated teaching
materials at bookstores or online.

Article 12 Use of Study Room
1. If you wish to use the study room, you need to make a reservation in advance.
2. The school will not be held responsible for any accidents or other problems that
may occur while using the study rooms. In addition, children under elementary
school age must be accompanied by a parent or guardian when using the room.

Article 13 Eating and Drinking at School
As a general rule, eating and drinking inside and outside the classroom is prohibited,
with the exception of beverages. However, students may use the water dispenser provided by
the school.

Article 14 Prohibited Items
Please do not bring into the classroom anything other than what is necessary for the
lesson. (Especially dangerous items such as scissors, cutters, lighters, etc.)

Article 15: Entering the Lesson Room
Unless instructed by the instructor, please understand that only students are allowed to
enter the classroom during the lesson.

Article 16 Use of Parking Lot
1.There is a limit to the number of cars that can be parked in the school’s parking lot.
Even if you come to the school by car, you may not be able to use the parking lot. In such
cases, please use the nearby coin-operated parking lots.
2. The school will not be held responsible for any accidents or other problems that may
occur in or around the school parking lot.
3. Please do not park on the street in front of the school.

Article 18 Cancellation of Membership
In the event that a member falls under any of the following circumstances, the school may
cancel or invalidate the membership without prior notice to the member.
1. When the school judges that the member has violated this agreement and it is not
appropriate to continue to accept the member as a member.
2. In the event that the member cannot be contacted.
3. In any other cases where the school judges that the member is inappropriate for
membership.

Article 19 Disclaimer
1. The school will not be responsible for any accidents, troubles, theft, or loss
caused on the way to school or by the carelessness of the student or guardian.
2. The effects of learning by using this service may vary from person to person. The
school does not guarantee the effectiveness of this service.
